01条款的接受

下载、安装或使用 Relax Sound（下称「本 App」）即表示你已阅读、理解并同意本使用条款。若你不同意其中任何内容，请停止使用并卸载本 App。

你需年满 13 周岁（或所在司法辖区规定的数字同意年龄）方可使用本 App。若你为未成年人，请在监护人同意与陪同下使用。

02许可与使用范围

我们授予你一项个人的、非独占的、不可转让、不可再许可的有限许可，允许你在自己拥有或控制的 Apple 设备上安装并使用本 App，用于个人的放松、专注与助眠场景。

本许可不包含任何所有权转移。App 内所有音频素材、界面设计、图标、文字与代码的知识产权均归我们或相应权利人所有。

03内购与会员

本 App 的全部声音主题与界面功能无需付费即可使用。部分内容（如全部声音主题与配色主题，以及未来新增的内容）可通过可选的内购解锁；本 App 不含广告。

内购分为自动续订订阅与一次性买断两类，全部由 Apple 的 App Store 处理（In-App Purchase）。具体有哪些内购项目、各自的周期、价格、免费试用政策与可用地区，一律以 App 内购买页面与 App Store 结算页面实时显示的信息为准 —— 本条款不列举具体项目与价格，以免与商店实际展示的不一致。

一次性买断的内购支付一次即长期有效，不会自动续费，也无需续费；其权益与本 App 在本平台（iOS）的存续相绑定。订阅类内购的续订与取消规则见下一条。

04订阅与自动续订

订阅类内购（如有）遵循以下规则：

• 订阅将在每个周期结束前 24 小时内自动扣费并顺延一个周期，除非你在此之前取消；
• 你可随时在「设置 → Apple 账户 → 订阅」中查看、变更或取消订阅；
• 取消后，当前已付费周期结束前仍可继续使用会员权益，到期后自动回到免费状态；
• 卸载本 App 不会自动取消订阅。

若某项订阅提供免费试用，其试用期长度、资格与试用结束后的收费标准以 App 内与 App Store 结算页面显示为准；须在试用结束前取消（Apple 通常要求提前 24 小时）才不会产生费用。免费试用资格通常每个 Apple 账户仅可使用一次，具体以 App Store 判定为准。

05恢复购买、换机与退款

• 恢复购买：在同一 Apple 账户下重新安装或换用新设备后，打开 App 内的解锁卡片或「设置 → 会员」点「恢复购买」，即可重新获得已购买的权益。
• 跨平台：当前版本仅支持 iOS。权益与 Apple 账户绑定，无法跨到其他平台的独立版本使用。
• 退款：所有付款均由 Apple 处理，退款需按 Apple 的 App Store 政策通过 Apple 申请（ reportaproblem.apple.com）。我们无权直接为你办理退款。

06使用限制

你同意不会：

• 对本 App 进行反向工程、反编译、反汇编，或试图获取其源代码；
• 提取、导出、再分发 App 内的音频素材或界面素材，或将其用于其他产品；
• 绕过、破解或干扰会员校验与内购机制；
• 出租、出售、转授权本 App，或将其用于任何商业性再分发；
• 以违反当地法律的方式使用本 App。

若你违反上述限制，本许可自动终止，我们可要求你停止使用并卸载本 App。

07知识产权

本 App 的界面设计、图标、程序代码、文字说明，以及经授权使用的音频素材，均受著作权及相关法律保护。未经书面许可，不得复制、修改、传播或用于商业用途。本条款未授予你任何商标或品牌使用权。

08与 Apple 的关系

本条款仅存在于你与我们之间，与 Apple Inc. 无关。你需要知悉：

• Apple 无义务为本 App 提供任何维护与支持服务；
• 若本 App 不符合任何适用的保证，你可以通知 Apple，Apple 将按 App Store 政策退还相应购买金额（如有）；
• Apple 不负责处理你或任何第三方就本 App 提出的索赔，包括产品责任、消费者保护、知识产权侵权等；
• Apple 及其子公司是本条款的第三方受益人，并有权作为第三方受益人执行本条款。

09免责声明与健康提示

本 App 按「现状」和「现有」提供，不附带任何形式的明示或默示保证，包括但不限于适销性、特定用途适用性与不侵权的保证。我们不保证 App 运行绝对不中断或无错误。

重要健康提示：

• 本 App 提供的是环境音，用于放松、专注与助眠，不是医疗器械，不能用于诊断、治疗、治愈或预防任何疾病或睡眠障碍；
• 长时间以高音量收听可能损伤听力，请将音量控制在舒适范围内，勿在睡眠时使用过高音量；
• 请勿在驾驶、操作机械或任何需要保持注意力的场合使用本 App；
• 若你有睡眠障碍、耳鸣、听力问题或精神健康方面的困扰，请咨询专业医师，本 App 不能替代专业意见。

10责任限制与条款变更

在适用法律允许的最大范围内，我们不对因使用或无法使用本 App 而产生的任何间接、附带、特殊、后果性或惩罚性损害（包括数据丢失、利润损失）承担责任；我们的累计责任以你在提出索赔前 12 个月内为本 App 实际支付的金额为上限。

我们可能不时更新本条款，更新后会在本页面修改「最近更新」日期并在 App 版本更新说明中提示。重大变更后继续使用即视为接受新条款。我们也可能随时变更、中止或终止本 App 或其部分功能；若终止付费服务的提供，将提前通过 App 内或本页面公告。

11准据法与争议解决

本条款的订立、效力、解释与争议解决均适用中华人民共和国法律（不含冲突法规则）。因本条款产生的争议，双方应先友好协商；协商不成时，提交我们住所地有管辖权的人民法院裁决。本条款不排除你所在司法辖区强制性消费者保护法赋予你的权利。

01Acceptance

By downloading, installing, or using Relax Noise (the “App”) you confirm that you have read, understood, and agreed to these Terms of Use. If you disagree with any part, please stop using the App and delete it.

You must be at least 13 years old (or the digital age of consent in your jurisdiction) to use the App. If you are a minor, please use it with the consent and supervision of a guardian.

02Licence and scope of use

We grant you a personal, non-exclusive, non-transferable, non-sublicensable limited licence to install and use the App on Apple devices you own or control, for personal relaxation, focus, and sleep.

No ownership is transferred. All intellectual property in the audio assets, interface design, icons, text, and code of the App belongs to us or the respective rights holders.

03In-app purchases and membership

Every sound theme and interface feature of the App is usable without paying. Some content (such as all sound themes and colour themes, plus future additions) can be unlocked through optional in-app purchases. The App contains no advertising.

In-app purchases come in two forms — auto-renewing subscriptions and one-time purchases — and are all handled by Apple's App Store. Which items exist, their billing periods, prices, free-trial terms, and availability are governed solely by what the in-app purchase screen and the App Store payment sheet show at the time. These terms deliberately do not list particular items or prices, so they cannot fall out of step with the store.

A one-time purchase is paid once and stays valid indefinitely, with no renewal and nothing further to pay; it is tied to the App's continued availability on this platform (iOS). Renewal and cancellation rules for subscriptions are in the next section.

04Subscriptions and auto-renewal

Where a subscription is offered, the following applies:

• the subscription is charged automatically within 24 hours before each period ends and extends for another period, unless you cancel before then;
• you can view, change, or cancel at any time under Settings → Apple Account → Subscriptions;
• after cancelling you keep membership benefits until the paid period ends, then return to the free tier;
• deleting the App does not cancel a subscription.

If a subscription offers a free trial, its length, eligibility, and the price charged when it ends are as shown in the app and on the App Store payment sheet; cancel before the trial ends (Apple usually requires at least 24 hours' notice) to avoid being charged. Free-trial eligibility is usually available once per Apple Account, as determined by the App Store.

05Restoring purchases, new devices, refunds

• Restore purchases: after reinstalling or moving to a new device on the same Apple Account, tap “Restore Purchases” on the unlock card or under Settings → Membership to regain what you bought.
• Cross-platform: the current release is iOS only. Entitlements are tied to your Apple Account and cannot be used in a separate version on another platform.
• Refunds: all payments are handled by Apple, and refunds must be requested from Apple under App Store policy ( reportaproblem.apple.com). We cannot issue refunds directly.

06Restrictions

You agree not to:

• reverse engineer, decompile, or disassemble the App, or attempt to derive its source code;
• extract, export, or redistribute the App's audio or interface assets, or use them in another product;
• circumvent, crack, or interfere with membership verification or in-app purchasing;
• rent, sell, or sublicense the App, or use it for commercial redistribution;
• use the App in any way that breaks applicable law.

If you breach these restrictions, this licence terminates automatically and we may ask you to stop using and delete the App.

07Intellectual property

The App's interface design, icons, source code, and written content, along with the licensed audio assets, are protected by copyright and related laws. They may not be copied, modified, distributed, or used commercially without written permission. These terms grant you no trademark or brand rights.

08Relationship with Apple

These terms are between you and us only, not with Apple Inc. You should know that:

• Apple has no obligation to provide maintenance or support for the App;
• if the App fails to conform to any applicable warranty you may notify Apple, and Apple will refund the purchase price (if any) under App Store policy;
• Apple is not responsible for handling any claims by you or a third party relating to the App, including product liability, consumer protection, or intellectual-property infringement;
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them as such.

09Disclaimer and health notice

The App is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will run uninterrupted or error-free.

Important health notice:

• the App provides ambient sound for relaxation, focus, and sleep. It is not a medical device and may not be used to diagnose, treat, cure, or prevent any disease or sleep disorder;
• prolonged listening at high volume can damage your hearing. Keep the volume comfortable and avoid high levels while sleeping;
• do not use the App while driving, operating machinery, or anywhere you need to stay alert;
• if you have a sleep disorder, tinnitus, hearing problems, or mental-health concerns, please consult a qualified professional. This App is not a substitute for professional advice.

10Limitation of liability and changes

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages (including lost data or lost profits) arising from your use of, or inability to use, the App. Our total cumulative liability is capped at the amount you actually paid for the App in the 12 months before the claim.

We may update these terms from time to time by revising the “Last updated” date on this page and noting the change in the App's release notes. Continued use after a material change means you accept the new terms. We may also change, suspend, or discontinue the App or parts of it at any time; if we discontinue a paid service, we will announce it in the App or on this page in advance.

11Governing law and disputes

These terms, their validity, interpretation, and any dispute are governed by the laws of the People's Republic of China (excluding conflict-of-law rules). Disputes should first be resolved through friendly negotiation; failing that, they shall be submitted to the competent people's court where we are domiciled. Nothing here excludes rights granted to you by mandatory consumer-protection law in your jurisdiction.
